The worker commits fraud to the employer if, in a period of transitory working incapability or common illness
The worker commits fraud to the employer if, in a period of transitory working incapability or common illness, or during incapability due to a work accident it is proved that:
- The worker is performing a job, either being self-employed or for another person or company.
- The worker’s daily life is in contradiction with his or her illness or injury.
- It is proved that the worker is not following correctly or completely the medical prescription.
This kind of behaviour infringes the Workers Statute, in which it is written that honesty and the aim of fulfilling the job obligations are taken for granted when signing the contract.
The evidence obtained by the detective could be used to justify the dismissal of the worker.
-We will observe the daily life of the employee and get evidence of it
-Outings and movements of the investigated person
-In case of injury or long illness, we will check if the incapability to work is real
-We will demonstrate the possible work activity of the investigated person
-Surveillance of those activities that can go against the medical treatment.
